Why we are consulting The Dual-Use Regulation sets rules for the export, transit, and brokering of dual-use items – goods, software, and technology that can be used for both civilian and military purposes, including weapons of mass destruction (WMD) or human rights violations. The Regulation was adopted on 20 May 2021 and upgraded (as compared to the previous regulation) the EU's export control toolbox to address technological advancements, to enhance the human rights and security dimensions, and to ensure a more unified approach across EU Member States with the objective of responding to an evolving geopolitical landscape. The Regulation aims to: - Contribute to maintaining international and regional peace and security by preventing dangerous exports. - Establish a link between export controls and human rights by controlling exports of cyber-surveillance technology that could be used for surveillance and repression. - Reduce administrative burden for businesses through the use of EU General Export Authorisations (EUGEAs). - Enhance transparency and reporting by including concrete reporting obligations for Member States. - Support legitimate trade while minimising risks to security and fundamental rights. Article 26(4) of the Dual-Use Regulation requires the Commission to carry out an evaluation of the Regulation, including Article 5 concerning controls of exports of cyber-surveillance technology, and report its main findings to the European Parliament, the Council and the European Economic and Social Committee between 10 September 2026 and 10 September 2028. To this end, all interested citizens and civil society organisations, irrespective of their geographic location, are invited to participate in this survey.…
