Who enforces EU dual-use export controls?

Licensing and enforcement sit with national competent authorities in each Member State — typically economy or trade ministries — supported by customs at the border. The European Commission maintains the framework and coordinates through the Dual-Use Coordination Group, and the control list is updated by delegated act, but there is no central EU licensing body; penalties for violations are a matter of national law.

What counts as a dual-use item?

Items — including goods, software and technology — that can be used for both civil and military purposes, as specified in the control list in Annex I of Regulation 2021/821, which tracks the multilateral regimes such as the Wassenaar Arrangement. Unlisted items can also be controlled under catch-all provisions where they may be intended for WMD programmes, certain military end-uses or, for cyber-surveillance items, serious human rights violations.

Do intra-EU transfers of dual-use items need authorisation?

Mostly no: dual-use items generally circulate freely within the EU. However, a limited category of particularly sensitive items listed in Annex IV requires authorisation even for intra-EU transfers, and Member States can impose additional controls in defined circumstances. Exports outside the customs territory of the EU require authorisation whenever the item is listed or a catch-all applies.
