When the ATKM finds terrorist or child pornographic material on your hosting service or platform, you will receive a removal order from us. Obligations for hosting services Online terrorist material EU Regulation 2021/784 requires hosting service providers to remove terrorist material within one hour after receiving a removal order. The ATKM can send such a removal order to providers, but authorities from other Member States of the European Union can do so as well. A Dutch provider can lodge an objection with the ATKM against removal orders from other Member States. The provider can also ask the ATKM to review the removal order from another Member State in order to assess whether it was rightly sent. In addition to the obligation to remove terrorist online content within one hour, the EU Regulation also imposes other obligations on hosting service providers. The ATKM can take administrative enforcement action if these obligations are not complied with. The main other obligations are: - Hosting service providers must have a contact point to receive removal orders and to be able to execute them quickly. - Hosting service providers must state in their general terms and conditions what their policy is for countering the dissemination of terrorist material. - Hosting service providers must handle complaints in a user-friendly manner. They must also handle complaints quickly and transparently. - If hosting service providers remove online material after receiving a removal order, they must preserve that material. The material may be reinstated after an objection or appeal procedure. - Hosting service providers must prepare a report if they have taken measures to prevent the dissemination of terrorist material. Online child pornographic material The Administrative Law Approach to Online Child Pornographic Material Act requires providers of hosting or communication services to make child pornographic material inaccessible within the maximum period of 12 hours after receiving an order. The ATKM can send such an order when online child pornographic material is found.
