Who decides whether a foreign investment into the EU is approved?
The individual Member State whose screening regime applies. The EU regulation establishes cooperation and information exchange: the European Commission and other Member States may issue opinions or comments on transactions affecting security or public order, and these must be given due consideration, but the final screening decision — clearance, conditions or prohibition — rests with the reviewing Member State.
Which sectors are typically caught by EU FDI screening?
The regulation lists factors Member States may consider, including critical infrastructure, critical technologies and dual-use items, supply of critical inputs including energy and raw materials, access to sensitive information and personal data, and media freedom and pluralism.
